To enter the Hockey Pool™ Playoff via the Internet, you must complete the registration and entry forms available at Hockey Pool. This Contest is offered by The Roto Times®, a division of CDM Sports®. There is a limit of ten (10) entries per customer in the Contest. All Internet entries must be paid by credit card, using either: MasterCard, VISA, American Express or Discover, and must be received at least 5 minutes before the start of the first playoff game on Tuesday, April 30, 2013. All credit card transactions are processed through CDM Sports. Debit card overdraft fees are the sole responsibility of the customer.
To enter the Contest, you must be a person at least 21 years of age or older and physically located in a state, territory, or province in which participation in the Contest is unrestricted by law. The Contest is open to individuals who have reached legal age in their respective jurisdiction. Individuals who have not reached legal age in their respective jurisdiction are ineligible and cannot win prizes. Void where prohibited by law. Employees and immediate family members of CDM Sports, its sponsors, affiliates, subsidiaries, advertising and promotional agencies are not eligible to win prizes. In addition, residents of some states, territories, or provinces may not be eligible to win prizes. Before entering the Contest, each individual should check the laws of the state, territory or province in which he or she resides to determine eligibility to win prizes. CDM Sports reserves the right to determine eligibility, in its sole discretion, and the right to change eligibility requirements at any time if it determines that changes are necessary in order to comply with applicable laws, rules and regulations.
Game of Skill
The Contest is a game of skill. From all entries received, winners are those individuals who use their skill and knowledge of relevant professional hockey information and fantasy hockey rules to accumulate the highest point totals during the Contest according to the official Contest rules.
The Contest begins with playoff games on April 30, 2013, and ends with the final playoff hockey game, spanning the entire hockey playoffs.
Winners are determined and prizes are awarded as provided in the official rules of the Contest. Prize winners will be required to compete an affidavit of eligibility and liability release and may be required to provide a certification for tax withholding (including, without limitation, either a W-9 or a W-8BEN.) The prize will only be paid to the person who is identified by CDM Sports as having submitted the entry for the Contest. Failure to submit accurate and complete information at any time may result in forfeiture of prizes. All taxes associated with the receipt or use of any prize are the sole responsibility of the winner. You are advised to consult your tax advisor for tax advice concerning your prize winnings. A 30% U.S. income tax withholding (and/or such other withholding as is required by U.S. law) will be applied to all non-U.S. prize winners. In the event that the awarding of any prizes to winners of the Contest is challenged by any legal authority, CDM Sports reserves the right, in its sole discretion, to determine whether or not to award such prizes.
Cash prizes are awarded in U.S. dollars. In the event of a tie, cash prizes are divided evenly among those who have tied.
Please allow 2-3 weeks from the conclusion of the Contest to receive your prize. If you are required to sign an affidavit of eligibility and liability release, please allow 2-3 weeks from the time your signed affidavit and release is returned to CDM Sports. All prizes are awarded regardless of the number of entrants or amount of entry fees received. No substitution or transfer of prize is permitted, except that CDM Sports reserves the right to substitute a prize of equal value or greater if the advertised prize is unavailable.
Winners are notified by email or regular mail within ten (10) days after the official final overall results are posted at the conclusion of the Contest. Winners are also posted on the Contest website. Winners must return via email or regular mail an affidavit of eligibility and a liability/publicity release (unless prohibited by law) within (fifteen) 15 days following attempted notification. Failure to comply with this requirement can result in disqualification and forfeiture of prizes. Any prize notification returned as undeliverable may result in disqualification and selection of an alternate winner. After six (6) months, any unclaimed prize will be forfeited.
Publicity; Promotional Activities
By accepting any prize, the winners grant permission to The Roto Times and to CDM Sports to use their names and/or likenesses for publicity and promotional purposes without further compensation, (unless prohibited by law), and agree to execute a written consent. In the event of dispute about the identity of any entrant, entries made online are declared made by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner can be required to provide the sponsors with proof that the potential winner is the authorized account holder of the email address associated with the winning entry.
Internet/Technology Problems; Tampering
If, as a result of viruses, bugs, tampering, unauthorized intervention, fraud, technical failures or other causes beyond the control of either The Roto Times or CDM Sports, the administration, security, fairness, integrity or proper conduct of the Contest is corrupted or compromised, The Roto Times and CDM Sports reserve the right, in their sole discretion, to cancel, terminate, modify or suspend the Contest. Neither The Roto Times nor CDM Sports is responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers, equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, phone lines, or any combination thereof, including any injury or damage to a participant's computer related to or resulting from participation in this Contest. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF LAW. CDM Sports reserves the right to disqualify any individual who tampers with the entry process or contest operation and reserves the right to seek recovery of damages from such individual to the fullest extent permitted by law.
No Warranties; Limitation of Liability
THE CONTEST AND ALL SERVICES ASSOCIATED WITH THE CONTEST ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE ROTO TIMES' AND CDM SPORTS' MAXIMUM LIABILITY TO ANY PARTICIPANT IN THE CONTEST FOR ANY CLAIM (INCLUSIVE OF ATTORNEYS' FEES) ARISING OUT OF OR IN CONNECTION WITH PARTICIPATION IN THE CONTEST, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE FOR LOSSES OR DAMAGES SUSTAINED BY THE PARTICIPANT IS LIMITED TO THE AGGREGATE AMOUNT OF ALL FEES PAID BY THE PARTICIPANT TO PARTICIPATE IN THE CONTEST. IN NO EVENT SHALL CDM SPORTS, ITS SUBSIDIARIES, AFFILIATES, RELATED PARTIES, DIRECTORS, OFFICERS, MANAGERS, AGENTS, REPRESENTATIVES OR CONTEST SPONSORS BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, OR SPECIAL DAMAGES, UNDER ANY CIRCUMSTANCES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Neither The Roto Times nor CDM Sports is responsible for delays or failure to perform if the delays or failure to perform is caused by the occurrence of an act, omission, or condition beyond its control, whether or not foreseeable, including without limitation, acts of God, riots, terrorists' acts, war, fire, flood, or power failure. In addition, neither The Roto Times nor CDM Sports is responsible for any late, lost, garbled, misdirected, incomplete, or damaged entries or for printing or typographical errors in any materials and content associated with the Contest. Neither the Contest nor the Contest website are sponsored or endorsed by either the NHL or NHLPA.
Release and Indemnification
By participating in the Contest, you agree to release The Roto Times and CDM Sports, its subsidiaries, affiliates, directors, officers, managers, employees, agents, representatives, and Contest sponsors from any liability for any losses, or damages of any kind arising out of or in connection with your participation in the Contest or acceptance, possession, or use of any prize. In addition, you agree to indemnify and hold harmless The Roto Times and CDM Sports, its subsidiaries, affiliates, directors, officers, managers, employees, agents, representatives, and Contest sponsors from and against any liability for any third party claims, costs, injuries, losses, or damages of any kind arising out of your participation in the Contest or acceptance, possession, or use of any prize.
